General Information:

The Education Foundation is a philanthropic organisation that promotes and supports innovative projects in government schools. ruMAD? is a Curriculum Framework set up by the Education Foundation which enables young people to lead change in their community by becoming active citizens.

Website Terms:

  2. www.rumad.org.au (ruMAD?) is operated by the Education Foundation ARBN 121 463 527 (Education Foundation). Before registering as a member of www.rumad.org.au you must agree to and accept these Terms of Use. The Terms of Use are designed to ensure that all use of www.rumad.org.au by members is legal, and to ensure that all members agree to participate within a safe environment. www.rumad.org.au is intended for Australian residents only and is not intended for use by any person who is a resident of any other country as the Content or these Terms of Use may not comply with non-Australian laws. By clicking the "I ACCEPT" button at registration, you agree to be bound by the Terms of Use. Your use of the information, graphics, text, software and materials (Content) on www.rumad.org.au is governed by these Terms of Use.

  4. www.rumad.org.au may contain links to third party websites. Education Foundation does not sponsor or endorse the operators or content of any linked websites. Subject to any applicable law which cannot be excluded, Education Foundation makes no warranties or representations: (a) regarding the quality, accuracy, merchantability or fitness for purpose of any linked websites, material or products or services; or (b) that material on linked websites does not infringe the intellectual property rights of any person. By linking to those websites, Education Foundation is not authorising the reproduction of material on linked websites.
  5. Website features
  6. www.rumad.org.au may from time to time contain or make available various message services, email lists, mailout or newsletter services, or other tools and facilities which may be of use to you. Whilst Education Foundation has made every effort to ensure that any such features are accurate and free from defect, Education Foundation does not warrant the accuracy, correctness or completeness of these features, which are provided on an "as is" basis.
  7. Website availability
  8. As electronic services are subject to interruption or breakdown, access to www.rumad.org.au is offered on an "as is" and "as available" basis. Education Foundation may withdraw www.rumad.org.au at any time and without notice to you.
  9. Usernames and Passwords
  10. You must not disclose your Username or Password to any person. You must take all reasonable steps to keep your Username and Password secure so that it is kept protected from use by any other person. Should you become aware that another person has used/is using your Username or Password you must notify the Education Foundation immediately. Upon receipt of notification, the Education Foundation will deactivate your Username and Password for security reasons, and you will then be required to create a new Username and Password. Until we receive such notification, you are solely responsible for any use of www.rumad.org.au through your Username and Password, whether authorised or not.
  11. User Content
  12. It is solely the responsibility of members to determine whether the Content you submit to the www.rumad.org.au site is suitable for public viewing. As a member of www.rumad.org.au you must not post or upload any content which:
    • is inappropriate, offensive or contrary to any applicable laws or standards;
    • is obscene or indecent; depicts violence, sexual activity or pornography; or contains instructions in crime or drug use;
    • defames, harasses, threatens, abuses, offends or embarrasses any person;
    • impersonates any person or suggests a connection to any group or organization which is misleading;
    • advocates the use of force or violence toward any person;
    • encourages, endorses, approves or recommends the performance or use of dangerous or illegal acts;
    • is fraudulent, misleading or deceptive;
    • infringes any third party‚s copyright, patent, trade mark, trade secret or other intellectual property rights or proprietary rights or rights of publicity or privacy (including identifying any individual or their contact details without their consent);
    • is harmful, hateful or discriminatory;
    • impinges on any other user’s, use or enjoyment of www.rumad.org.au;
    • is designed or intended to obtain personal information from any other user;
    • contains any "prohibited content" or "potential prohibited content" within the meaning of Schedule 5 of the Broadcasting Services Act 1992 (Cth);
    • contains a virus or other code that has harmful or destructive properties. Any Content that you send to, or attempt to include in www.rumad.org.au may be made publicly available to all users of www.rumad.org.au and Education Foundation accepts no responsibility for third party use of that Content. Whilst under no obligation to do so, Education Foundation retains the right to review, edit, and remove any Content whatsoever from any part of www.rumad.org.au at any time and without notice to you.
  13. Third party personal information
  14. If you access any personal information about other individuals through www.rumad.org.au, you must keep that information confidential unless you have their consent.
  15. Termination and suspension
  16. Education Foundation reserves the right to monitor and review member status at any time. Education Foundation may terminate your membership and suspend your access to member sections of the www.rumad.org.au site if at any time you breach the Terms of Use. We reserve the right, without notice and in our sole and absolute discretion, to discontinue, suspend or terminate any service offered by or through www.rumad.org.au as well as www.rumad.org.au at any time. For example, if your server is involved in any attack on any computer system, either with or without your knowledge or complicity, that server may be blocked or its access to www.rumad.org.au may be shut down or restricted while the problem is being investigated or fixed. All provisions of these Terms of Use which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, disclaimers, indemnities and limitations of liability.
  17. Photo/Video/Image Permission:
  18. You acknowledge that any Content submitted by you to the www.rumad.org.au site is and will be treated by the Education Foundation as non-confidential. That is, where uploading Content, you as the member must ensure that any necessary permission has been obtained. By placing any Content on www.rumad.org.au, you grant to us an irrevocable, perpetual, royalty-free, non-exclusive, worldwide licence to use, edit, reformat, reproduce, publish, redistribute, transmit, broadcast, display, create derivate works from, communicate to the public and make an adaptation of that Content, and that the Education Foundation may use that Content, in (without limitation) any of its promotional, advertising and marketing activities in Australia and overseas. You also agree that we may sublicense any of those rights to third parties. You acknowledge that Content that you send to, or attempt to include in www.rumad.org.au, may not reach or be correctly displayed on www.rumad.org.au for a variety of reasons including but not limited to mechanical, software, computer, telecommunications or electronic failure. You further acknowledge that, to the extent permitted by law, Education Foundation is not liable to you or anyone else in any way for any loss or damage at all and however caused, arising directly or indirectly in connection with the receipt of information by, or the inclusion of Content in, or a failure to receive or include Content in, www.rumad.org.au, for whatever reason.
  19. Intellectual Property:
  20. The Education Foundation owns and licenses all intellectual property rights in the materials on this site. In particular, all curriculum materials pertaining to the ruMAD? Program Framework. Also including and without limitation the text, graphics, logos, icons, images, video and audio clips, designs, interfaces, and layout of the www.rumad.org.au site. Except where necessary for viewing the Content on this website or your browser, or as permitted under the Copyright Act 1968 (Cth) or other applicable laws or these Terms of Use, no Content on www.rumad.org.au may be reproduced, adapted, uploaded to a third party, linked to, framed, performed in public, distributed or transmitted in any form by any process without the prior written consent of Education Foundation or our licensor(s) (as appropriate).
  21. Warranties
  22. While we have made every effort to ensure that the Content is free from error, Education Foundation does not guarantee or warrant the accuracy, adequacy or completeness of Content on www.rumad.org.au. All Content is provided on an "as is" basis and without guarantees or warranties of any kind, either express or implied. All terms implied by law, except those that can not be lawfully excluded, are excluded. All Content is subject to change without notice. Education Foundation does not warrant that www.rumad.org.au or any linked websites will be free from viruses or defects.
  23. Limitation of Liability
  24. Subject to any responsibilities implied by law and which cannot be excluded, Education Foundation, and its directors, employees, agents and contractors, are not liable to you for any losses, damages, liabilities, claims and expenses (including but not limited to legal costs and defence or settlement costs) whatsoever, whether direct, indirect or consequential, arising out of or referable to any Content on www.rumad.org.au, to any material on linked websites, or to access or use of www.rumad.org.au by you, howsoever caused, whether in contract, tort including negligence, statute or otherwise. If a jurisdiction allows liability to be limited but not excluded, our total liability is limited to the maximum extent possible. For example, under the Trade Practices Act 1974 in Australia, our liability for any breach of a condition or warranty that is implied by law and cannot be excluded is limited to the extent possible to us doing any one or more of the following (at our election):
    • resupplying goods or services to you or supplying equivalent goods;
    • repairing the goods; or
    • paying the cost of having the goods or services resupplied or goods repaired.
    Nothing in these terms and conditions is intended to exclude, restrict or modify rights which you may have under the Trade Practices Act or any other legislation which may not be excluded, restricted or modified by agreement.
  25. Indemnity
  26. You indemnify Education Foundation in respect of any liability incurred by Education Foundation for any loss or damage, howsoever caused, suffered by Education Foundation as a result of your breach of these Terms of Use or your use of www.rumad.org.au.
  27. Jurisdiction
  28. The law applicable to www.rumad.org.au and to disputes arising out of www.rumad.org.au is the law of the State of Victoria, Australia.
